DHSS Rule Would Ban Cannabis Plant Sales

Missouri’s medical marijuana law under Article XIV of the Missouri Constitution allows patients to legally cultivate cannabis. Under a new proposed Missouri Department of Health and Senior Services (DHSS) rule, card carrying cannabis patient cultivators would not be legally able to obtain cannabis clones, seedlings or plants.

The DHSS proposed a rule which would prohibit Missouri medical marijuana dispensaries from selling plants, seedlings or clones to medical marijuana patients and their caregivers.

Proposed rule: “( ) Dispensary facilities shall only sell medical marijuana seeds acquired from cultivation facilities and may not sell medical marijuana plants at any stage of development;

If this rule is enacted, cannabis plants at any stage of growth will not be available to patients or caregivers.

Public comments about this proposed rule will be accepted from Missouri citizens until Monday, June 8, 2020.

Send a message to the DHSS now in objection to this rule! (via NORML comment form).

We must use our voices to tell DHSS that there is no reason to prohibit dispensaries in Missouri from selling clones or seedlings to patients and caregivers who may wish to cultivate cannabis.

The only people who might benefit from this proposed rule are those who are in the for-profit commercial marijuana cultivation business. DHSS has always said that the welfare of patients is their highest priority. Please remind the DHSS that this rule does not benefit any legal medical cannabis patient in Missouri.

Medical marijuana in dispensaries may be too expensive for many patients. Article XIV guarantees medical cannabis patients the right to cultivate and consume cannabis they have grown themselves. This rule will reduce the available legal options to obtain medical cannabis plants or clones.

Please contact DHSS right away and let them know that this rule will be harmful to patients and serves no legitimate purpose!
